A person is found guilty of privacy violation under class A misdemeanor and class G if a person installs an electronic tracking device on a motor vehicle without the consent of the registered owner, lessor, or lessee. It is illegal for a person to use a GPS device to locate another person without consent.

North Dakota

In North Dakota, stalking is considered an unauthorized tracking of a person’s location to the extent that they start feeling frightened or intimidated.

An unusual case was brought in the court against the police for using a GPS tracker on the vehicle owned by a suspected drug trafficker. The rulings were against the law enforcement agency. Why? As the act was a violation of the fourth amendment of human rights. 

  • Cunningham VS New York Department of Labour 2013

An employee sued his employer for tracking his vehicle after working hours without his consent. 

Surprisingly the court ruled in the employer’s favor. Why? As the records clearly show that the employee was taking his work hours.

  • United States VS Katzin 2013

A case was brought in the court against the police for placing a GPS tracker on a suspect. The court ruled in favor of the Katzin brothers. Why? As it was considered a violation of the fourth amendment.
